What is stealthing? Stealthing is when a partner removes a condom mid intercourse without the other’s knowledge or clear consent. It can happen to both men and women, however, women are often the victims of stealthing. This non-consensual act is reported in straight and gay communities, and even among committed, long term relationships and married couples. This so-called “sex-trend” has been increasing in recent years. URL For Article: https://www.npr.org/2021/10/07/1040160313/california-stealthing-nonconsensual-condom-removal California passed a law in October 2021 regarding this act. Stealthing will not be a crime under California law, but it will be a civil offense, allowing people who experience it to sue the perpetrators directly in civil court if they choose to. See note below regarding the differences between a civil law and a criminal law. Read the article and respond to the following prompts. Respond to each prompt separately. I expect a short paragraph, 3 – 5 sentences, for each prompt. 1. What is your reaction to the California law that makes stealthing a civil offense? 2. Do you think stealthing should be illegal? If so, do you think it should be a criminal offense rather than a civil offense? Explain your reasoning for your position. 3. Is stealthing the same as when a woman lies about being on birth control? Explain why or why not. Use one inch margins, double spaced lines, and 12 point Times New Roman font. A title page is not required. If you use any sources other than the above article you should include links to the sources at the end of your paper. The assignment should be submitted on Canvas as PDF or Word document. Note: There are many differences between a civil law and a criminal law. In general, civil law deals with civil and private rights and criminal law deals with crimes and their punishments. An important distinction between civil and criminal law is the type of penalty paid for being found guilty. In a criminal case, if the individual charged with a crime loses the case, they’re likely facing incarceration or some type of probation. For civil cases, the resolution to a case doesn’t result in the “losing” party going to jail. Often, a civil judgment results in a financial penalty and/or an order to change behavior.
